The client and JANER DE LUCA SL with NIF B75515668 agree to lease with skipper of the vessel contracted for the service: Sailing excursion along the coast of Menorca.

For any extension or change of schedule, the consultation and consent of the lessor will be required.

The price includes a) civil liability and occupant insurance, b) the skipper, c) VAT, d) fuel, e) snorkeling equipment, and f) beverage.

The price does not include the recording camera. If the lessee wishes to use it, it must be agreed upon separately from this contract.

The lessee shall make the payment by any of the following means:

1. Bank transfer.
2. Cash payment.
3. Credit/Debit card payment.
4. Bizum.

Reservation. – The lessor delivers to the lessee an amount as a reservation deposit. This amount will be deducted from the final lease price.

Documentation. – The lessee must send to the lessor the complete list of the crew who will be on board the vessel at the moment the lessee returns this contract signed on all its pages.

Adverse meteorological conditions. – Adverse meteorological conditions, unless the lessor considers that such factors compromise the safety of the crew, will not constitute a determining reason for the termination of the contract and refund of its amount; the parties will agree on a new day if possible.

However, if it is not possible to change the day and the weather conditions compromising the safety of the crew, the lessor will refund the amounts received to the lessee.

Returns and refunds. – In the case of return or refund of amounts paid by the client, these will be refunded by the same means of payment used by the client.

Safety and buyer protection. – The website and website links comply with SSL protocols.

1. A) Hull all-risk civil liability insurance.
2. B) Occupant insurance with maximum coverages per person: 1) accidental death up to a maximum of EUR 12,020.30, 2) permanent disability up to a maximum of EUR 12,020.30, 3) medical expenses, including those under Royal Decree 1575/1989.

Nevertheless, the lessor shall not in any case be responsible for injuries and/or personal damages to the crew or third parties, nor for any material damages of any kind to the vessel itself or to third-party vessels and/or naval artifacts that may occur as a result of accidents arising in connection with 1) diving, 2) swimming, and 3) any activity such as paddle surfing, etc., as well as any other activity that has not been expressly contracted by the lessee with the lessor.

Skipper of the vessel. – The lessor will provide a Skipper, possessing the knowledge, experience, and qualification required for navigation. The leased vessel may be operated solely and exclusively by the designated Skipper.

Use of the vessel. – The lessee shall use the leased vessel exclusively for recreation or pleasure, with any other use strictly prohibited.

Subleasing or transferring the leased vessel is strictly prohibited.

The lessee undertakes not to carry on board more persons than the authorized capacity.

The lessee agrees to follow the maritime safety and marine environment protection guidelines suggested by the Skipper of the vessel.

On board, cooking, transporting animals, or throwing any kind of object into the sea is not permitted.

The leased vessel may only navigate at sea up to the maximum distance established by its current seaworthiness certificate.

Under no circumstances may the vessel navigate beyond the limits established for the Skipper in command, in accordance with their nautical qualification, or beyond those set by current legislation.

Any extension beyond the aforementioned navigation limits will require written authorization.

Contract withdrawal. – Once the reservation has been made, the lessee shall be obliged to pay the agreed price, even if, for any reason, they are unable or choose not to make the planned voyage. All of this is except in the following cases:

In the event of cancellation by the client, the cancellation fee will be 0% if made 72 hours or more in advance; 25% if made between 72 and 48 hours in advance; 50% if made between 48 and 24 hours in advance; and 100% if made less than 24 hours in advance.

In the event that the company is delayed by more than two hours in carrying out the charter, the full rental amount will be refunded to the lessee, in the event of being unable to provide the lessee with a vessel identical to the one leased.

Breaches and liabilities. – The responsibilities that may be incurred due to breach of this contract shall be borne by the lessee and the crew members designated by them.

The lessor shall be responsible for the acts and liabilities that the Skipper of the vessel may incur.

In the event of negligence, mistreatment of the vessel, breach of the law, or any clause of this contract, the lessor is granted the right to terminate the contract immediately, and all amounts paid shall remain with the lessor as compensation.

Express submission. – The parties agree that any dispute or claim arising from or in connection with this contract or its performance will be submitted to and resolved by the Courts and Tribunals of the Island of Menorca, Balearic Islands (Spain).

Expenses. – All expenses of any kind, without exception, that arise or are caused as a result of the voyage planned by the lessee shall be borne exclusively by the latter.

Clauses contrary to mandatory rules. – If any of the preceding stipulations were wholly or partially contrary to mandatory rules, such stipulation(s) shall be deemed null and void, with the remainder of the contract fully in force.

In the case of shared excursions, there must be a minimum of four persons.

Shared Excursions. – In the case of shared excursions, we assist in creating a group, and once formed, if any person does not wish to belong to it, the amount paid will be refunded. Within the group, members must agree for the contract to be in the name of one person; if they do not accept this condition, the amount paid will also be refunded.

Cancellation Policy

Once the client makes their reservation, the company’s hiring and cancellation conditions will be understood as known, read, and accepted. Therefore, we recommend reading the CONDITIONS carefully before making the reservation and ensuring that the reservation to be made is for the desired activity, date, and time:

CANCELLATIONS OR NO-SHOWS

Passengers must present themselves at the indicated meeting point at least 15 minutes before departure time. Any passenger who does not show up at the departure point ready to take the excursion at the indicated time, whether due to delay or any other reason, will lose their excursion as well as the amount paid. If this occurs and they wish to take the trip at another time, they must make a new reservation and pay again.

The client may cancel their reservation by sending us a written request (by email/SMS/WhatsApp) up to 3 days before the contracted date, possibly incurring a penalty determined by how far in advance the request is made, as detailed below:

– Up to 3 days before the contracted date and local time: 100% refund of the total.

– Up to 2 days before the contracted date and local time: 75% refund of the total.

– Up to 1 days before the contracted date and local time: 50% refund of the total.

– Within 24 hours prior to the contracted date and local time: cancellations for any cause or circumstance will not be refunded.

In case of partial cancellations (cancellation of any of the reserved spots), there will be no refund of the canceled spot(s).

CHANGES TO RESERVATIONS

The client may request a change of date, time, or name of the passengers in their reservation by sending us a written request (by email, SMS, or WhatsApp) no later than 10 days before the date of the excursion. The date and time change will be subject to availability.

CANCELLATIONS BY THE COMPANY

This is an outdoor activity, so environmental conditions may vary and not always be ideal. Sometimes it may be windy or cloudy; one must consider this possibility and accept that the excursion could take place under those conditions, and, ultimately, it will always be the Skipper’s decision whether conditions are appropriate to carry out the excursion. Cloudiness or wind, as long as under the Skipper’s judgment they do not prevent the proper development of the activity, will not be grounds for cancellation. Likewise, if the Skipper deems during the excursion that the conditions of a particular cove at that moment are not suitable for visitation or bathing, they may decide to visit another cove with better conditions instead. This may be due to a large influx or presence of vessels in one cove or presence of jellyfish or water turbidity, for example.

It is impossible to know in advance what the weather will be like on the scheduled day of the trip, and it may also happen that the excursion must be canceled at the last moment before boarding or even during the excursion due to worsening meteorological or maritime conditions. Each case will then be analyzed to proceed with the appropriate refund.

Under no circumstances will possible additional expenses assumed by the client for carrying out this activity (travel to the departure point, etc.) be refunded.

If, at the time of the excursion, any cause arises that makes it impossible to carry out the planned excursion (including vessel breakdown or Skipper unavailability), we will attempt to reschedule for another day or time, provided that this is the client’s wish, the cause of cancellation has been remedied, and we still have availability. If none of the above is possible or the client is not interested, a full refund of the amount paid will be made.

Refunds will always be made by the same payment method used for the reservation.
